Patient's families cannot appeal to NMC against state council orders

In a new development, families of patients can not appeal to the National Medical Commission against the decision of state medical councils. This was discovered by families when their appeals were rejected citing a provision in the NMC act that allows only doctors to appeal against decisions of state councils. Earlier, the Medical Council of India allowed patient’s appeals following a Supreme Court directive in 2004.

The appeals are being rejected citing section 30(3) of the NMC act of 2019, which replaced the Indian Medical Council Act. The NMC was brought because it was considered that the MCI had gone beyond incremental improvements and required a complete renovation. However, for patients looking for justice, the cure may be worse than the disease.
